Terms of Service

1. Agreement to terms

By creating an account or using any part of the Evysse platform (the "Service"), you agree to these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms. If you do not agree, do not use the Service.

2. The Service

Evysse provides an automated platform for beauty professionals that handles client bookings, deposit collection, appointment reminders, and client communication via Instagram DM, WhatsApp, and other connected channels. The automation operates on your behalf, within the tone, services, and policies you configure. You remain responsible for the accuracy of the information you provide (services, prices, availability, policies) and for reviewing the automation's activity.

3. Accounts

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to use the Service.
  • One person or business may not maintain more than one early access account at a time.
  • You are responsible for all activity that occurs under your account.

4. Plans, billing, and early access

Plans

Evysse offers paid plans (Solo, Pro, Business) and custom Enterprise agreements. Plan details, pricing, and included AI actions are listed on our pricing page. We reserve the right to change pricing with 30 days' notice to existing customers.

Early access

During the early access period prior to launch, the Service is provided free of charge to all signed-up users. No credit card is required. At launch, you will be asked to select a paid plan and provide payment information to continue using the Service. If you do not subscribe, your account will be paused; your data will be retained for 30 days before deletion. Users who sign up during early access lock in their founding rate for the life of their subscription.

Billing

Monthly plans are billed on the same date each month. Annual plans are billed as a one-time upfront payment for 12 months. All prices are in USD unless otherwise stated. Payments are processed through Stripe.

AI action overages

Each plan includes a monthly AI action allowance. If you exceed your allowance, additional actions are billed at the per-action overage rate for your plan ($0.05 for Solo, $0.04 for Pro, $0.03 for Business). You can set a monthly spending cap in your dashboard to control overage costs. Overage charges are billed at the end of each billing cycle.

Additional seats

The Business plan includes 3 team members. Additional seats are available at $10/month per seat. Seats are billed on the same cycle as your plan.

Cancellation

You can cancel your plan at any time from your dashboard. Monthly plans: cancellation takes effect at the end of the current billing period, with no further charges. Annual plans: include a 30-day money-back guarantee from the date of purchase. After 30 days, the annual payment is non-refundable, but you retain access for the remainder of the year.

5. Your data and content

  • You own your data. Client lists, booking records, service catalogues, conversation histories, and notes belong to you.
  • You grant Evysse a limited licence to process your data solely to operate the Service, including running the AI agent, processing bookings, and sending messages on your behalf.
  • You can export your data at any time.
  • Upon account deletion, your data is removed within 30 days, except where retention is required by law.

6. AI agent and automated actions

The Evysse AI agent acts on your behalf to reply to client messages, book appointments, send deposit links, send reminders, and enforce cancellation policies. While we design the AI to be accurate and reliable:

  • The AI operates within the services, pricing, availability, and policies you configure. You are responsible for keeping this information accurate and up to date.
  • The AI may occasionally produce responses that are imprecise or incomplete. You should periodically review your agent's activity and conversation history.
  • Evysse is not liable for bookings, communications, or actions taken by the AI agent on your behalf. You remain responsible for your business operations.
  • The AI does not provide medical, legal, or financial advice. It will refer clients to you for questions outside its scope.

7. Payments and deposits

Evysse facilitates deposit collection and payment processing through Stripe. Important details:

  • You connect your own Stripe account. All client payments (deposits and balances) are deposited directly to your Stripe account.
  • Evysse charges zero commission on your bookings or earnings.
  • Stripe's fees apply to transactions processed through your Stripe account. These fees are set by Stripe and are separate from Evysse subscription costs.
  • You are responsible for setting deposit amounts, cancellation policies, and refund terms. Evysse enforces whatever policy you configure.
  • Evysse is not a party to the transaction between you and your client. Disputes about services, refunds, or chargebacks are between you, your client, and Stripe.

8. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Impersonate another person or business
  • Transmit spam, unsolicited messages, or bulk communications unrelated to legitimate client relationships
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Interfere with the security or integrity of the Service
  • Use automated scripts or bots to interact with the AI agent for purposes other than normal business use
  • Resell or sublicence the Service without written permission

We reserve the right to suspend or terminate accounts that violate these terms.

9. Third-party integrations

The Service integrates with third-party platforms including Instagram (Meta), WhatsApp (Meta), Google Calendar, Apple Calendar, Stripe, and Clerk. Your use of these integrations is also subject to the respective third-party terms of service and privacy policies. Evysse is not responsible for the availability, performance, or policies of third-party platforms.

10. Workspace isolation

Each workspace on Evysse is fully isolated. Data from one workspace (client lists, bookings, conversations, revenue) is never accessible to another workspace. Studio owners using the Business plan can view aggregated data across their team members' workspaces, but individual team members cannot access each other's data.

11. Service availability

We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may perform scheduled maintenance, deploy updates, or experience outages beyond our control. We will make reasonable efforts to notify you of planned downtime in advance. The AI agent may be temporarily unavailable during outages; messages received during downtime will be queued and processed when service resumes.

12. Limitation of liability

To the maximum extent permitted by law, Evysse and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, loss of clients, or loss of data, arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to Evysse in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold Evysse harmless from any claims, damages, losses, or expenses (including legal fees) arising from: your use of the Service, your violation of these Terms, your business operations and client relationships, or any content or data you provide to the Service.

14. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you disagree with the changes, you may cancel your account before the effective date.

15. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Delaware.
